This criminal appeal under Section 374(2) Cr.P.C. has been filed against the judgement order dated 28.04.2015 passed by Additional Sessions Judge, Fast Tract Court, Hardoi in Sessions Trial No. 8/2012, State vs. Babu, arising out of Crime No. 1073 of 2011, P.S. Atrauli, District Hardoi, whereby learned Trial Court has convicted and sentenced the appellant under Section 363 for three years R.I. and fine of Rs. 3000/-, in default of payment of fine further one month simple imprisonment, under Section 366 I.P.C. five years R.I. and fine of Rs. 5000/-, in default of payment of fine further two months simple imprisonment and under Section 376 I.P.C. for ten years R.I. and fine of Rs. 10,000/- in default of payment of fine, further four months simple imprisonment.  All the sentences are directed to run concurrently.

Admit.

Learned A.G.A. is present for respondent-State of U.P., therefore, there is no need to issue notice to the State.

Lower Court's record may be summoned through District and Sessions Judge, Hardoi by Special Messenger.

List on 19th June, 2015 for hearing of bail application along with record of learned lower Court.
