Heard Sri M.S. Khan, learned counsel for the revisionist and learned A.G.A. for the State of U.P.

This criminal revision has been filed for quashing/setting-aside the impugned order dated 13.4.2015 passed by learned Sub Divisional Magistrate, Sadar, Lucknow in Case No. 16/54 of 2015, State vs. Jagdish Pal and another, under Section 133 Cr.P.C., Police Station Krishna Nagar, District Lucknow, whereby the proceedings of the case was dropped.

Learned counsel for the revisionist submits that revisionist is resident of Osho Nagar and the way in respect of which the proceedings of the above case were dropped, the same is used by some other resident of Osho Nagar. Learned counsel for the revisionist further submits that revisionist has not been provided any opportunity of producing evidence as well as hearing, as such, the impugned order dated 13.04.2015 passed by the Sub Divisional Magistrate is illegal, wrong and liable to be set-aside.

Learned A.G.A. tried to defend the impugned order.

Issue notice to respondent nos. 4 and 5, returnable at an early date.

Necessary steps for service be taken by the revisionist within a week.

Summon the lower court record.
