In this case, the only question of law involved is that whether the seniority shall be determined in terms of Rule 22 of the U.P. Basic Education (Teachers) Service Rules, 1981, caderwise or the entire length of service of a teacher shall be taken into consideration.
This matter is engaging the attention of this Court in Writ (A) No. 36240 of 2015 (Tapeshar Ram and another vs. State of U.P. and others.)
Both the parties agree that no factual controversy is involved in the matter. There is purely a question of law.
Sri Daya Ram Yadav, learned Advocate appears for respondent Nos. 2 and 3.
In view of the said fact, learned counsel for the District Basic Education Officer may seek the instructions in the matter.
It is made clear that the writ petition may be finally disposed of on the next date of listed.
Considering the facts of the case, for the reasons stated in Writ (A) No. 36240 of 2015, it is directed that no further steps will be taken in pursuance of the impugned seniority list.
Put up this case on 3rd August, 2015 in the additional cause list along with Writ (A) No. 36240 of 2015.
