Heard learned counsel for the applicant, Sri Mahboob Ahmad, Adv. appeared for the opposite party no.2, and learned A.G.A. for the State.

This application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of Criminal Case No. 19 of 2010, pending in the court of Special Judge (E.C. Act) Varanasi under Section 135 Electricity Act.

Learned counsel for the applicant has contended that with reference to the proceeding taken u/s 135 Electricity Act, the applicant had already deposited the amount for compounding. He has further submitted that in spite of depositing entire amount, the impugned charge sheet has come to be submitted.

The matter requires consideration.

Issue notice to opposite party no.2 returnable within six weeks at the address given in the application.

Opposite party no.2 may file counter affidavit within six weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.

List immediately after expiry of the aforesaid period before the appropriate Bench.

Till the next date of listing, further proceedings of the aforesaid case shall remain stayed against applicant.
