Heard Sri R.K.Srivastava, learned counsel for the petitioners, the learned standing counsel for the respondents and Sri Rajesh Bhat holding brief of Sri R.B.Yadav, learned counsel for the Gaon Sabha.

In substance the petitioner appears to be aggrieved by the non disposal of the petitioners' application dated 11.8.2004 filed under section 28 of the U.P. Consolidation of Holdings Act, 1953 pending before the respondent no.4.

Having heard the learned counsel for the parties the writ petition is disposed of with the observation that the petitioners' application dated 11.8.2004 filed under section 28 of the U.P. Consolidation of Holdings Act, 1953 pending before the respondent no.4 shall be considered and decided in accordance with law by passing an appropriate order, expeditiously, if possible within a period of 6 months from the date of filing of a certified copy of the order of this Court without granting unnecessary adjournment to either of the party.

It may be clarified that I have neither addressed myself on the maintainability of the application nor its merit and it shall be in the sole domain of the authority concerned to decide the same  in accordance with law on its own merit.
