According to the learned Counsel for the petitioner, the Hon'ble Administrative Judge while deciding the representation has quashed the promotion order dated 21.7.2014 of the petitioner without affording any opportunity to the petitioner and has directed for re-process of promotional exercise. According to the petitioner's Counsel the opposite party no. 3 in the year 2009-10 has been awarded punishment and it was directed that he shall not be given any responsible post. He further submits that the criteria for promotion is seniority cum merit for the post in question.

Sri Upendra Mishra appearing for the respondents nos 1 and 2 prays for a three days time to seek instructions and produced record relating to opposite party no.3 as also the broad sheet prepared by the selection committee for assessing the merit of the eligible candidates.
