Heard Sri Satya Prakash Pandey, learned counsel for the petitioner and Sri Amar Nath Singh, learned Standing Counsel for the respondents.
The petitioner is seeking quashing of the order dated 07.03.2014 whereby his promotion on the post of Head Constable has been cancelled. It is stated that the petitioner was promoted on the post of Head Constable by order dated 21.02.2014, copy of which has been filed as Annexure-1 to the petitioner. At that time the petitioner informed the Department that there was criminal case pending against him. Thereafter by the order dated 07.03.2014 his promotion order was cancelled. It is stated that the petitioner has now been acquitted in criminal case vide judgment of the Additional Sessions Judge, Kanpur Nagar dated 10.07.2015 in Criminal Appeal No.166 of 2014.
In this view of the matter, no useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties that the petitioner may submit a representation before the respondent no.3 Superintendent of Police, Fatehpur bringing this fact to his knowledge and thereafter the respondent no.3 shall consider and decide the same in accordance with law.
