Heard learned counsel for the appellants and perused the impugned judgement.

No one appears on behalf of the respondents inspite of sufficient service in the revised list. 

The second appeal is admitted on substantial questions of law no. I, VI and VII as framed in the memo of second appeal.

Summon the lower court's record through the District Judge concerned.

On the application for interim relief, this Court by an order dated 14.3.2014 stayed the execution of decree with condition that the appellants shall deposit entire damages @ Rs. 2000/- per month w.e.f. 31.7.2000 and continue to deposit  Rs. 2000/- per month with the trial court.

The submission of learned counsel for the appellants is that he has already moved an application for modification of the aforesaid passed by Hon'ble Mr. Justice S.K. Saxena, therefore, the application for modification be listed before his Lordship in the first week of January, 2016.
