Heard learned counsel for the applicant, learned AGA for the State respondent and perused the records.
The car of informant was robbed, for which FIR was lodged against unknown persons. Thereafter, next day of incident of robbery, applicant and co-accused were allegedly found in possession of looted car when police was in search of accused in another murder case.
Learned counsel for the applicant contended that applicant was falsely implicated in the present case and thereafter several other cases were imposed on him for creating false criminal history. He further contended that all the cases of criminal history were registered after arrest of the petitioner in present case.
Without expressing any opinion on merit of the case, considering the detention of applicant for about 5 months and absence of any criminal history before the date of incident, the applicant is entitled for bail.
Let the applicant Rajeev involved in case crime no. 244 of 2015, under Section 392, 411 IPC, P.S. Shamli, District Shamli be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of the court concerned.
