2014 Latest Caselaw 6883 ALL

Citation : 2014 Latest Caselaw 6883 ALL
Judgement Date : 23 September, 2014

Allahabad High Court
Mahaveer Singh vs State Of U.P. And 4 Ors on 23 September, 2014
Bench: Rajan Roy

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 59

Case :- WRIT - A No. - 51583 of 2014

Petitioner :- Mahaveer Singh

Respondent :- State Of U.P. And 4 Ors

Counsel for Petitioner :- Rajendra Prasad Tiwari

Counsel for Respondent :- C.S.C.,J.P.S. Jadaun

Hon'ble Rajan Roy,J.

Heard learned counsel for the petitioner Jai Shankar Audichya alongwith Sri J.P.S. Jaduan, learned counsel for caveator/respondent no. 5.

The petitioner is aggrieved by the impugned orders by which the charge of post in question has been taken away from the petitioner he has been directed to handover to the same to respondent no. 5.

In my view there is no prejudice caused to the petitioner because neither his salary  nor rank has been  reduced. Neither violation of any policy nor statute is alleged.

There exists no ground for interference under article 226 of the Constitution of India.

However, if the petitioner feels aggrieved, he may move a representation before the State Government within one month, and in such an event, the same shall be considered and decided by Respondent no. 1 within a period of two months thereafter.

Subject to the above, the writ petition is dismissed.
