The grievance of the petitioner is that after the death of her husband (who died in harness on 17.1.2013), she is entitled to payment of family pension and other benefits, but the same has not been paid till date.
If there is no impediment in the payment of family pension to the petitioner, and she if she is entitled for the same, there is no reason why the respondent is sitting over the matter for so long.
Taking into consideration the facts of the case, without adjudicating the claim of the petitioner on merit, the writ petition is disposed of with the direction to Superintendent of Police, district Sant Kabir Nagar (Respondent no. 2) to look into the matter and take a reasoned and speaking decision in this regard within a period of two months from the date of receipt of certified copy of this order. The decision so taken shall be communicated to the petitioner. If the petitioner is found eligible and entitled for such payment as claimed by her, the same shall be released in her favour without any further delay.
With the aforesaid observations/directions, the writ petition is disposed of.
