In the present case it is submitted that the petitioner while filling up the form on line has inadvertently mentioned in the form her category as OBC though she belongs to a general category. According to the petitioner, she has moved a representation before the Secretary, UP Basic Education Board, Allahabad but her case was not considered.
It is contended by the counsel for the petitioner that the respondents have recently issued a public notice in respect of another selection for Assistant Teacher wherein candidates were asked to make corrections of their papers where there were some inadvertent mistakes. He has also relied upon the following decisions.
(i) [2012] 7 Supreme Court 638; Price Waterhouse Coopers Pvt Ltd Vs. Commissioner of Income Tax, Kolkata-1.
(ii) Divison Bench Decision of this Court passed in Special Appeal No. 1812 of 2013; Vijai Luxmi Vs. State of UP and
(iii) Division Bench decision reported in (2012) 3 ADJ 219; Archana Rastogi Vs. State of UP.
Learned standing counsel prays for and is granted six weeks time to file counter affidavit.
Taking into consideration of the case, in the meantime, it is provided that the petitioner may move a fresh representation before respondent no. 3, who will pass appropriate orders on her representation. The said order shall abide by the result of the writ petition.
