Argument is that impugned order has been passed on incorrect premises and from record it is clear that there is no slackness in the discharge of judicial work, and therefore, petitioner is entitled to get protection from this Court.

It is further argued that in the similar set of facts this Court entertained writ petition and granted interim protection (page 36 and 38 of the writ petition).

In view of the aforesaid, respondents are directed to file counter affidavit on or before the next date.

List this matter after six weeks.

As an interim measure, this court provides that till the next date of listing operation of the order of suspension dated 14th August, 2014 shall remain stayed. However, it is made clear that inquiry, if any,  against the petitioner is to proceed in which petitioner undertakes to cooperate.

Order Date :- 18.9.2014
