Argument is that petitioner was transferred from Haiser Bazar, Sant Kabir Nagar, by order dated 23.08.2014 where he has joined but by the impugned order dated 03.09.2014 petitioner has been shifted to Belhar Kala and one Dr. Upendra Kumar Pathak has been transferred/posted at Haiser Bazar (page 21 of the writ petition).

Submission is that earlier transfer of the petitioner to Haiser Bazar was on his personal request, and therefore, there is no justification for passing the impugned order just within a period of ten days.

Learned Standing Counsel is to obtain instruction and apprise this court the correct/complete fact.

Let this matter be posted after three weeks.

As an interim measure, this court directs that till next date of listing operation of the order dated 03.09.2014 in so far it relates to the petitioner shifting him from Haiser Bazar to  Belhar kala will remain stayed.

It is always open for the competent authority to pass appropriate orders in respect to the posting of the petitioner and respondent no. 5.
