Counter affidavit was called upon by this Court vide order dated 29.1.201, but the respondents have chosen not to file any reply till date, though, more than 3 years have been passed.

It is really very unfortunate that respondents by their inaction and apathy do not respondent to the orders of this Court by filing counter affidavit and that is why the unnecessary and unavoidable delay is caused for disposal of the matter expeditiously. Besides being contemptuous it is otherwise derogatory.

Let respondent nos. 2 and 3 appear before this Court on 24.9.2014 to explain as to why they have not responded in the matter and filed counter affidavit till date. However, it is provided that in case the respondents file counter affidavit by 22.9.2014 and pay a cost of Rs. 5000/- to the petitioner, they need not to appear in court.

List this matter on 24.9.2014.

A copy of this order shall be made available to the counsel for respondent nos. 2 and 3 for communication to the concerned respondents and compliance.
