Heard Sri Ashok Khare, learned Senior Advocate assisted by  Sri Siddharth Khare for the petitioner and learned Standing Counsel.

Contention of Sri Khare, learned Senior Advocate  is that the petitioner was appointed in the women branch and all along been posted in the girls college,  but by means of the impugned order he has been posted in the Co-education college which is not permissible. Attention of the court was drawn to Rule 3(a) and Rule 4 of the U.P. Subordinate Eduction(Trained Graduate Grade) Service Rules, 1983,  wherein also women and men branch have been mentioned separately.

Learned counsel further submits that the transferring authority of the petitioner is Joint Director but in this case petitioner has been transferred at the dictate of the Additional Director,  as contained in the letter dated 9.10.2014.  He also submits that complaint has been made by the teachers and staff against respondent no. 8.

Put up on 3rd November, 2014, as a fresh case, to enable learned Standing Counsel to seek instruction as to what are the circumstances leading to the transfer of the petitioner and whether any action has been taken in the matter of respondent no. 8 in respect to the complaint made against her.
