1. Heard Sri Amit Manohar, learned counsel for the applicant and Sri Abhishek Tripathi, learned counsel for the respondent.
2. This is an application filed under Section 24 of the CPC requesting for transfer of Divorce Case No. 1199 of 2013 (Ajay Singh Vs. Smt. Sanju Singh) from the Court of Principal Judge, Family Court, Kanpur Nagar to competent court in Auraiya.
It is contended that the applicant is not getting any maintenance or financial help from the respondent and she has no source of income. It is difficult for the applicant to attend the proceeding in the case at Kanpur on every dates. Further her 'Jeth' is an Advocate at Kanpur Nagar and he is creating obstacle to get legal assistance at Kanpur Nagar.
3. However, since both the parties have consented for transfer of the aforesaid case to Etawah/ a third place, I am not going into rival dispute being unnecessary for the case in hand.
4. With the consent of learned counsels for parties, I direct that Divorce Case No. 1199 of 2013 (Ajay Singh Vs. Smt. Sanju Singh) pending in the Court of Principal Judge, Family Court, Kanpur Nagar is transferred to competent Court at Etawah Judgeship. The Court at Kanpur Nagar shall ensure immediate transmission of record to Etawah Judgeship.
5. The application is disposed of accordingly.
