Heard learned counsel for the applicant.
The present contempt application has been filed for punishing the respondent for wilful and deliberate disobedience of the order dated 19.3.2013 passed in civil misc. writ petition no. 767 of 2013.
Learned counsel for the applicant has drawn attention of this Court to annexure-1 to the affidavit, which is the order of writ court dated 19.3.2013, whereby the writ court had directed the trial court to decide the suits, mentioned in the order, expeditiously, preferably within a period six months from the date of production of certified copy of the said order. It is contended by the learned counsel for the applicant that the order of writ court was supplied to the trial court, but the suits have not been decided till date.
After hearing the learned counsel for the applicant, this court is of the opinion that the order of writ court was conditional order for deciding the suits expeditiously within the time specified in the order and no absolute order was passed for deciding the same. However, it is expected that the trial court shall decide the suits expeditiously, preferably within a period of six months from the date of production of certified copy of the order, without granting unnecessary adjooutnment to either of the parteis.
The present application is, accordinlgy, disposed of.
