Heard Sri Rajiv Nayan Singh, learned counsel for the applicant and Sri M.M. Khan, learned AGA for the State.

It has been submitted that vide order dated 11.04.2014 learned AGA is directed to file counter affidavit annexing the DNA report of the deceased Shivam. It appears from order sheet that several opportunities have been given to the learned AGA for obtaining the said report but till date no counter affidavit has been filed.

Leaned AGA states that in spite of the order being communicated to the Director, Forensic Science Laboratory, Agra for submitting the said DNA report, the same has not been received by him till date.

Learned AGA is further directed to file counter affidavit annexing the DNA report of the deceased Shivam by next date fixed, failing which the Director, Forensic Science Laboratory, Agra shall appear in person along with DNA report. 

Registrar General is directed to send the certified copy of this order to the Director, Forensic Science Laboratory, Agra as well as learned AGA for its compliance.
