Heard learned AGA for the Appellant-State and perused the impugned order.

Leave to appeal is granted. Admit and register appeal. Issue bailable warrant against accused-respondent. The Chief Judicial Magistrate, Kushi Nagar is directed to secure execution of bailable warrant against accused-respondent. The accused-respondent shall appear before the CJM, Kushi Nagar and in case of arrest by police he shall be produced before the CJM, Kushi Nagar, who shall enlarge the accused-respondent Yogendra Rajbhar, son of Santu Rajbhar on bail on furnishing a personal bond and two sureties each in the like amount to his satisfaction, with a direction that the accused-respondent shall appear before this Court on the date fixed either in person or through counsel.

The Compliance report shall be submitted by the CJM, Kushi Nagar by the next date fixed positively.

List on 30.1.2015 for hearing. Summon the record of the trial court also.
