This is a second application for bail moved on behalf of the accused-applicant Raman, involved in Case Crime No. 219 of 2012, under section 307 IPC, P.S. Jaswant Nagar, District Etawah. First application for bail has been rejected by this Court vide order dated 5.8.2013 passed in Criminal Misc. Bail Application No 6411 of 2013.

Heard learned counsel for the applicant, learned Additional Government Advocate and perused the record.

It has been argued that despite the detention of the applicant since 13.9.2012, the trial could not concluded as the court is vacant.

No new ground for grant of bail has been argued except the delay in trial.

Having considered the facts and circumstances of the case, without recording any finding on merit, I do not find any new ground to release the applicant on bail.

The application for bail is hereby rejected.

However, the trial court is directed to expedite the trial and conclude the same as expeditiously as possible, preferably, within a period of six months from the date of production of a certified copy of this order.

It is also directed that if the court is vacant, the Sessions Judge shall transfer the case to some other working court.
