A chak road had been provided on the eastern side of the chak of the petitioner. Aggrieved by the same, the petitioner filed an objection, which was allowed and the chak road on the eastern side was shifted and was carved out between the chaks of the petitioner and her son.
At the revisional stage, demand was made by the petitioner that the chak road be permitted to remain on the eastern side of her chak as proposed at the ACO stage on the ground that the chak road that has been ordered to be carved out would include the tube well of the petitioner.
Issue notice to the respondent nos. (3 to 6) by Registered Post A.D.
Steps be taken within a week.
Shri Arun Kumar Srivastava, has appeared for the respondent no. 7, Gaon Sabha may file a counter affidavit within four weeks
Learned counsel for the petitioner will have two weeks thereafter to file rejoinder affidavit.
List on a date fixed on the notice issued to respondent nos. (3 to 6).
Until further orders, the effect and operation of the impugned order dated 10.2.2014 shall remain stayed.
It is further provided that in case, there is no objection from any quarter, the chak road may be carved out as had been proposed at the ACO stage, on the eastern side of the petitioner's chak.
