The appeal is reported to be delayed by 145 days.

Explanation  for condonation of delay is found to be satisfactory.

Accordingly, delay in filing the appeal is condoned.

Heard learned Standing Counsel for the  appellant and Sri Vijay Gautam, learned counsel who appeared for respondent.

Undisputedly, the issue involved stands referred to the Full Bench by an order dated 7th November, 2012 which is placed before us.

Therefore, hearing of the present special appeal is deferred until the outcome of  said reference.

Learned Standing Counsel prays that for the period hearing of the special appeal is deferred, the State Government may be granted protection only to the extent of payment of past arrears of salary as may be admissible to the respondents, however State Government undertakes to re-instate the respondent.

Prayer made by the learned Standing Counsel is granted to the extent that payment of arrears of salary shall remain stayed subject to reinstatement of the respondent.
