It has been submitted by the learned counsel for the petitioner that in proceedings for allotment of chaks an order was passed by the Deputy Director of Consolidation (DDC). Both the parties filed applications to the effect that the correction table was not prepared in consonance the order itself. On the said ground, the correction in the order was prayed for. The DDC instead of correcting the correction table recalled the order and passed a fresh order which amounts to reviewing the earlier order passed on merits.
Shri V.P. Gupta, learned Advocate filed his appearance on behalf of respondent no. 3 in Court today while Shri R.S. Mishra, learned Advocate, appears for the respondent no. 2. Both the counsel for respondents pray for and are granted three weeks time to file counter affidavit.
Learned counsel for the petitioner will have two weeks thereafter to file rejoinder affidavit.
Issue notice to the respondents (no. 4 to 6) by registered post A.D.
Steps may be taken within ten days.
List this matter on the date fixed in the notice.
Till the next date of listing, the effect and operation of the impugned orders dated 4.4.2013 and 11.3.2013 passed by the DDC shall remain stayed.
