Heard learned counsel for the appellant, learned AGA for the State and perused the record.

Appellant Ajeet Kumar Mishra was convicted in Sessions Trial No. 213/2003 arising out of case crime no. 506/2001 under Sections 147, 148, 149, 323, 324, 325, 504, 506, 307, 302 IPC, P.S. Chanda, District Sultanpur.

It is submitted by the learned counsel for the appellant that there was cross case. It is submitted that both the sides, sustained injuries.  The appellant was on bail during trial. The appeal is not likely to be heard in near future.

Considering the facts and circumstances of the case, I find it a fit case for bail.

Let the appellant be released on bail on his furnishing two sureties and a personal bond in the like amount to the satisfaction of court concerned.

Realisation of fine shall also remain stayed.
