Heard the learned counsel for the petitioner and the learned A.G.A.
This petition has been filed by the petitioner Shamim Ahmad with a prayer to quash the impugned F.I.R. in case crime no.228 of 2014, under section 386, 506 I.P.C. P.S. Wazirganj, district Lucknow.
From the perusal of the impugned F.I.R. it appears that on the basis of the allegations made therein a prima facie cognizable offence is made out. There is no ground for interference in the impugned F.I.R. Therefore, the prayer for quashing the impugned F.I.R. is refused.
The second prayer sought is for transferring the investigation of case crime No. 228 of 2014 under section 386, 506 IPC, from local police to any other independent agency like C.B.I. We do not find any reason to transfer the investigation to C.B.I. Such prayer is refused.
However, it is directed that in case the petitioner is having any grievance the same may be raised before S.S.P. Lucknow who shall look into the matter expeditiously.
With the above direction this petition is finally disposed of.
