Learned counsel for the petitioners contends that the petitioner no.1 was married to respondent no.3. On account of matrimonial dispute the criminal proceedings came to be initiated. It has also been projected before this court that there are chances of settlement of disputes, if the matter is referred to Mediation and Conciliation Centre of this Court.
Issue notice to respondent nos.2 and 3 through Chief Judicial Magistrate, Pratapgarh, returnable on 18.8.2014.
List on 18.8.2014.
Petitioners are directed to deposit a sum of Rs.10,000/-(Ten thousand only) with the Registry of this Court within ten days from today.
In case, respondent no.3 agrees to join mediation proceedings, Rs.7000/-(Seven thousand only) would be released in favour of respondent no.3 and the remaining Rs.3000/-(Three thousand only) would be remitted in favour of the Mediation and Conciliation Centre of this Court.
Further proceedings in the case shall remain stayed only till the next date of hearing.
It is made clear that stay shall operate only on deposit of the sum, above recorded.
Let the respondent no.3 and petitioner no.1 remain present in court on the next date of listing.
