Heard learned counsel for the petitioners and learned A.G.A.
This petition has been filed by the petitioners Haseeb Abdullah And Anr. with a prayer to quash the FIR of case crime No. 544 of 2013 under sections 395 IPC, P.S. Wazirganj, District Lucknow.
From the perusal of the FIR it appears that on the basis of allegation made therein the prima facie cognizable offence is made out. There is no scope of interfering in the FIR. Therefore, the prayer for quashing the FIR is refused.
However, considering the submission made by learned A.G.A. that in the present case investigation has been completed and final report has been submitted, the same has not been accepted and order of further investigation has been passed, it is directed that till the pendency of further investigation, the petitioners shall not be arrested.
With this direction, this petition is finally disposed of.
