Heard counsel for the petitioner and learned standing counsel on behalf of the respondents.

The petitioner claims appointment on compassionate ground on the post of Police Constable. His case is that on initial medical examination, his height was 165.2 cm. but there is another report by the Chief Medical Officer, according to which, his height was 166 cm. and in view of conflict in the reports, a Medical Board was constituted, which is also of the opinion that the height of the petitioner is 166 cm. Even thereafter, the respondents are not taking any decision in the matter and have compelled the petitioner to join on a Class IV post. In this regard, the petitioner has made a representation on 8.11.2013.

Learned counsel for the petitioner submits that interest of justice would be served in case a direction is issued to respondent no.2 to pass appropriate orders on the representation of the petitioner dated 8.11.2013.

Learned standing counsel submits that in case representation is pending, appropriate decision shall be taken.

In view of the above, this writ petition is disposed of, without going into the merits of the claim of the petitioner with direction to respondent no.2 to decide the representation filed by the petitioner dated 8.11.2013 expeditiously, and preferably within a period of four months from the date of production of certified copy of this order before the said respondent alongwith photo copy of the representation dated 8.11.2013.
