Heard learned counsel for applicant and perused application moved under section 482 Cr.P.C.

Learned counsel for applicant has cited pronouncement of Hon'ble Apex Court rendered in the case of Sethuraman Vs. Rajamanickam reported in 2009 Law Suit (S.C.) 417 in which it has been held that order passed under section 311 Cr.P.C. is interlocutory order and revision is not maintainable.

In view of above notice is issued on this application moved under section 482 Cr.P.C.

Notice for opposite party no.1 State of U.P. was accepted by learned A.G.A.

Issue notice to opposite party no. 2 Gajraj Singh.

Steps may be taken within ten days.

Counter affidavit may be filed within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.

List on 19.2.2015 for hearing

Till next date of listing, final judgment shall not be passed by trial court in S.T. No.945 of 2010, under sections 147, 148, 149, 323, 324, 325, 308 I.P.C., Police Station Nehtaur, District Bijnor pending in the court of Additional Session Judge, Court No.7, Bijnor.
