In pursuance to the order passed by this Court on 16.5.2014, notice of the writ petition was served upon Sri Satish Chaturvedi who is said to be the learned counsel for State Bank of India, on 18.5.2014, but neither he has filed any Parcha/Vakalatnama, nor he is present. Earlier also notices were issued to the respondents to engage another counsel.
In the circumstances, the court has no option but to summon the respondent no. 4 i.e. the Deputy General Manager, State Bank of India, Zonal Office, 148 Civil Lines, Bareilly to appear before this Court on 18th December, 2014, along with relevant records to facilitate the disposal of the case.
It is however made clear that in the event proper counter affidavit along with relevant documents is filed before this court, before the next date, then the said officer need not appear.
Learned counsel for the petitioner undertakes to serve a copy of this order upon the said officer i.e. respondent no. 4, within three days.
List this case on 18th December, 2014.
Let a copy of this order be issued to the learned counsel for the petitioner, on payment of usual charges, if applied, by today itself.
