Argument is that impugned order of transfer dated 05.08.2014, so far it relates to the petitioner has been passed just to accommodate respondent no. 5, which is clear form the order of transfer of respondent no. 5 dated 01.08.2014.

Submission is that petitioner is resident of District Basti and he is to retire on 31.12.2014, and therefore, in view of the government policy, petitoiner was to remain at Kushinagar or at the desired place.

Issue notice to respondent no. 5. Steps will be taken within ten days.

Notices meant for respondents 1 to 4 have been accepted by learned Chief Standing Counsel.

Counter affidavit may be filed on or before the next date.

List immediately after service.

As  interim measure, this court directs that till next date of listing, if petitioner has not been relieved pursuant to the order dated 05.08.2014 then he will not be relieved pursuant to the impugned order.
