No body is present on behalf of the appellants even in the revised call of the cause list. 

The report of the Chief  Judicial Magistrate,  Farrukhabad referred to in the office note dated  27.8.2014 records  that appellant no.1 Siya Ram Lodhi has since expired.

In view of the said report, appeal of appellant no.1 Siya Ram Lodhi abates.

Office is directed to make a note of the same on the memo of appeal.

So far as the appellant no.2 Amar Singh is concerned, he could not be arrested as he was not  available at the place of  his residence and is stated  to have gone to Allahabad.

The appeal is of the year 1994. Hearing of the appeal cannot be proceeded with  for want of  assistance.

In such circumstances, we have no other option but to cancel the bail granted in favour of appellant Amar Singh under the order  of the Court dated  31.10.1945. It is ordered accordingly. 

Let the Chief Judicial Magistrate and Senior Superintendent of Police, Farrukhabad ensure that accused Amar Singh is arrested and is produced before this Court on the next date.

The matter  shall be listed on  16.9.2014. 

The Chief Judicial Magistrate and Senior Superintendent of Police, Farrukhabad  shall submit their compliance report before the court by the next date.

Copy of this order  be forwarded to the Chief Judicial Magistrate, Farrukhabad by 1.9.2014.

Office is directed to issue a copy of this order to the learned A.G.A. for necessary compliance by 1.9.2014.
