In view of specific averments made in paragraph nos. 8 and 9 of the application prima facie, a case for grant of an interim relief is made out.
Learned A.G.A. has accepted notice on behalf of opposite party no. 1.
Issue notice to opposite party no. 2 returnable at an early date.
Four weeks time is granted to opposite party no. 2 as well as learned A.G.A. to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.

Until further orders of this Court, further proceedings of Case No. 873 of 2013, Case Crime No. 27 of 2013, under Sections 4/21 Mines and Minerals (Development and Regulation Act 1957) under Rule 3/57/70 U.P. Mines and Minerals (Concession) Rule 1963 and 379, 411 IPC, P.S. Kone, District Sonbhadra pending in the court of Civil Judge (Junior Division)/ Dudhhi, Sonbhadra shall remain stayed as against the applicant.
