Heard learned counsel for the applicant and learned A.G.A.
Learned A.G.A. has accepted notice on behalf of opposite party no. 1.
Issue notice to opposite party no. 2 returnable at an early date. Steps be taken within a week.
Counter affidavit to be filed within four weeks by the learned A.G.A. as well as opposite party no. 2 and rejoinder affidavit to be filed within three weeks thereafter.
List thereafter.
After hearing learned counsel for the applicants and also in view of the fact mentioned that against the order of releasing the applicant under Section 169 Cr.P.C. a revision has been filed which is pending and at the same time the applicant has also been summoned in the protest petition vide order dated 07.06.2014, a certified copy of this order has been produced before this Court. In view of the aforesaid fact and circumstances, prima facie, a case for grant of an interim relief is made out.
Until further orders of this Court, further proceedings in Criminal Revision No.329 of 2013 (Rinku @ Ashish Kumar Vs. State) pending in the Court of Additional District and Sessions Judge, Shahjahanpur, under Sections 147, 148, 149, 307 IPC, Police Station Kant, District Shahjahanpur shall remain stayed against the applicants.
