Heard learned counsel for the applicant.
Learned A.G.A. has accepted notice on behalf of opposite party no. 1.
Issue notice to opposite party no. 2 returnable at an early date. Steps be taken within a week.
Four weeks time is granted to opposite party no. 2 as well as learned A.G.A. to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.
List thereafter.
In view of specific averments made in paragraph nos. 10-A, B and C of the affidavit accompanying the application, prima facie, a case for grant of an interim relief is made out.
Until further orders of this Court, entire proceedings of Case No. 1905 of 2012, (State Vs. Sanjay Chaurasiya and others), under Sections 419, 420, 467, 468, 471, 504, 506 IPC, P.S. Kotwali, District Gorakhpur pending in the court of Additional Chief Judicial Magistrate, Court No.3, Gorakhpur shall remain stayed as against the applicant.
