Report of the Chief Judicial Magistrate, Ballia referred to in the office report dated  19.8.2014, we find  that accused appellant Mahanta Bhar has not been arrested till date.

Nobody is present on his behalf. Therefore, hearing of criminal appeal cannot be proceeded with.

The bail granted in favour of appellant Mhanta Dhar was cancelled vide order dated 15.7.2014. Therefore, we direct Chief Judicial Judicial Magistrate, Ballia to initiate proceeding under Section 82/83 Cr.P.C. against the appellant Mhanta Dhar and further to initiate proceeding under section 446 Cr.P.C. against his sureties in terms  of the bail which was granted in  his favour as per the order of the High Court dated 28.7.1994. Action taken report be submitted before this Court on or before  11.9.2014 when the appeal shall be listed next.
