This writ petition has been filed seeking a writ of mandamus directing the Consolidation Officer, Badlapur, Jaunpur (Respondent no. 2) to expeditiously decide the application filed by the petitioner under Rule 109 A (2) of UP Consolidation of Holdings Act.

It is the contention of the petitioner that this application was filed on 21.7.2010. It has further been stated that no order sheet is being maintained in this case. Only a report was called for which has not been received. Report was dispatched by the Consolidator on 19.5.2014 but the same is not part of the file of the case under Rule 109.

Put up as fresh case on 29.8.2014 to enable the standing counsel to obtain instructions in the matter from the Consolidation Officer, Jaunpur (the CO) explaining as why the order sheet is not being maintained and why documents dispatched by the Consolidator in May, 2014 have not been placed in the file concerned even after 2 months.

In case instructions are not furnished by the CO by the date fixed, he shall be personally present in the Court on that date.

A copy of the order be given to the learned standing counsel during course of the day.
