After hearing the counsel for the parties, a detailed order had been passed on 25.7.2014. Apart from various other findings recorded therein, it was specified and made clear that on the next date only the point that will be considered is whether there has been any reduction in the area of the holdings of the petitioner beyond permissible limit on account of consolidation operations.

For this purpose, the counsel for the petitioner had also been granted time for filing copy of the petitioners' CH Form-23.

Today, when the case was taken up, a prayer for adjournment has been made. This court is not inclined to grant any adjournment because neither the statement that was required to be made by the counsel for the petitioner being made nor copy of CH Form-23 has been brought on record which would conclusively determine as to whether there was any reduction in the petitioners' holding beyond permissible limit on account of consolidation operations. 

Under the circumstances, the court is constrained to held that the plea raised by the petitioner that the area of his original holding having been reduced by more than 25% on account of consolidation operations is not correct as there is no evidence on record to substantiate this allegation.

All other points argued have already been already been decided by the order dated 25.7.2014 and therefore this order may be read in continuation of said order dated 25.7.2014.

Accordingly and for the reasons disclosed in the order dated 25.7.2014 and the order passed today, the writ petition is devoid of merits and it is dismissed.
