It has been submitted by Sri Pankaj Kumar Tyagi, learned counsel for the petitioner that a revision had been filed by one Subhash. It was dismissed by the order dated 23.9.2013. Surprisingly, Sri Yogesh filed a restoration application which was allowed and certain relief has been granted to Yogesh, shifting the petitioner's chak. It is contended that since Yogesh has never filed any revision, no relief could have been granted to him in a revision filed for third party.Moreover Yogesh could not maintain a restoration to recall an order dismissing a revision of Subhash, as he was not aggrieved by such dismissal.
The matter requires scrutiny.
Issue notice to respondent nos. 4 to 14 by registered post AD. Steps be taken within 10 days by registered post AD.
Until further orders of the Court, the effect and operation of the order dated 7.7.2014 passed by Deuty Director of Consolidation, Muzaffar Nagar shall remain stayed.
