Argument is that frequent transfer of the petitioner and allegation about various kind of complaints against him are totally frivolous, incorrect and motivated.

Submission is that petitioner was promoted on 17.5.2013 on higher post and he was posted to Aligarh and if there was something wrong against the petitioner he would not have been promoted. Now without any justification petitioner has been transferred from Aligarh to Gonda.

Respondents are represented by learned Standing Counsel. He may file counter affidavit on or before the next date.

List this matter after one month.

This petition was entertained on 1.8.2014 and by assigning reason the court called upon the respondents to given their version. It is said that in the intervening period new incumbent came and joined. This appears to be very strange that during pendency of the writ petition when on 1.8.2014 respondents were called upon to give their version, something to frustrate the order appears to have been done.

Be as it may, we stay the effect of the order of transfer dated 15.7.2014 (Annexure 7 to the writ petition) till the next date of listing.

It is made clear that he will be permitted to work at Aligarh and it is for the Government to pass order in respect to new incumbent.
