Allahabad High Court
Israrul Haq vs D.D.C. And 6 Ors. on 16 April, 2014
Bench: Anjani Kumar Mishra

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 18

Case :- WRIT - B No. - 20236 of 2014

Petitioner :- Israrul Haq

Respondent :- D.D.C. And 6 Ors.

Counsel for Petitioner :- Mohammad Farooq,Siddhartha Srivastava

Counsel for Respondent :- C.S.C.,Diwakar Singh

Hon'ble Anjani Kumar Mishra,J.

It is the contention of the learned counsel for the petitioner that although his appeal no. 4110 was allowed by the Settlement Officer, Consolidation on the ground that he was entitled to the area of plot no. 1923/8 which was valuable road side land yet in the correction table prepared, the modification was so made that the land allotted to the petitioner does not abut the road, it was therefore that a revision was filed which has been dismissed saying that since the appeal had been allowed the petitioner is not aggrieved party.  The petitioner has thus been allotted a chak which does not abut road despite the reasoning of the Settlement Officer, Consolidation that he is entitled to the same.

Matter requires consideration.

Issue notice to respondent nos. 3 to 6 by registered post A.D., returnable at an early date.

Steps may be taken within a week.

List on the date fixed in the notice.

Order Date :- 16.4.2014
