Heard Sri Akhtar Abbas, Sri B.P. Nigam for the appellants and Sri Umesh Verma, learned AGA and Sri Pramod Kumar for the complainant.
Apart from other arguments, it is urged that the only weapon recovered and alleged to be used in the incident was a country made point 3.15 bore weapon, however, pellets were also recovered from the body of the deceased and there is no explanation by the prosecution.
Accordingly, the appellant is entitled to bail.
Let the appellant Sri Chandra Pal Singh be released on bail in S.T. No. 232 of 2010, Case Crime No. 584 of 2009 under Sections 302, 506 IPC, P.S. Kachhauna, District Hardoi during the pendency of appeal on his furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the court concerned, with condition that the appellant shall report on every tenth day of month before police station concerned and the police shall record his presence and also watch his conduct. In case of any default, the State will be at liberty to move the cancellation of bail application.
