        Pursuant to the Order dated 18th September, 2013, the case has been listed today.

       By the Order dated 13th March, 2013, Notice was directed to be issued on Civil Misc. Restoration Application No. 344826 of 2009.

        By the Order dated 30th April, 2013, Office was directed to submit a fresh Report regarding Service of Notice on the respondent Nos. 2 to 4. 

       Pursuant to the Order dated 30th April, 2013, the Office has submitted fresh Report dated 28th May, 2013 and another Report dated 29th July, 2013 regrading Service of Notice issued to the respondent Nos. 2 to 4. 

       In view of the said Office Reports, Service of Notice on the respondent Nos. 2 to 4 is deemed to be sufficient.

       As regards, the respondent No. 1, Sri D.P. Singh, learned counsel for the petitioner states that in view of the Office Report dated 29th April, 2013, a Substitution Application supported by an Affidavit has been filed in the Registry on 6th August, 2013.  The said Application along with its supporting Affidavit, is not on record.  Office  is directed to trace out the same, and place it on record.

         List on 8th October, 2013.  

        The case will be listed amongst the cases listed at the top of the cause list of the said date.
