Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that only one case eachhas been shown in the gang chart in which he has been released on bail. The applicants are in jail since 15.08.2013. Therefore, the applicants may be released on bail.
After considering the facts, circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Mahmood Ali and Wajid Ali involved in case crime no. 718 of 2013 under Section 2/3 U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, P.S. Bhadokhar, District Raibareli be released on bail on their furnishing a personal bond and two heavy sureties to the satisfaction of the Court concerned with the following conditions:
*That the applicants shall not tamper with the evidence.
*That they shall report to the court of C.J.M. concerned in the first week of each month to show their good conduct and behaviour till the conclusion of the trial.
In case of default, in any of the above mentioned conditions, the bail granted to the applicants shall be deemed cancelled and they shall be taken into custody forthwith.
