Heard learned counsel for the applicants and the learned A.G.A.

It is submitted by learned counsel for the applicants that the applicants are named in the FIR along with other co-accused persons but during investigation  the charge  sheet has not been submitted against the applicants, it has been submitted agaisnt the other co-accused persons. The order co-accused persons have been released on bail, thereafter at the stage of trial, the applicants have been summoned under section 319 Cr.P.C. Therefore, the applicants may be released on bail.

After considering the facts, circumstances of the case and the submissions made by the learned counsel for the applicants and without entering into the merits of the case, the applicants are entitled to be released on bail.

Let the applicants Satish Sahu and Rahul Sahu involved in case crime no. 186 of 2011 under Sections 364-A/34, 302/34. 201/34 I.P.C., P.S. Gazipur, District  Lucknow be released on bail on their furnishing a personal bond and two heavy sureties to the satisfaction of the Court concerned with the following conditions:

*That the applicants shall not tamper with the evidence.

*That they shall report to the court of C.J.M. concerned in the first week of each month to show their good conduct  and behaviour till the conclusion of the trial.

In case of default, in any of the above mentioned conditions, the bail granted to the applicants shall be deemed cancelled and they shall be taken into custody forthwith.
