A supplementary affidavit is filed today from the side of the applicant with the averment that he has not been supplied with the copies of the papers under section 207 Cr.P.C. regarding which P.W.6 has been allowed to be further examined by the C.B.I.
Learned counsel for the C.B.I. wants to file a reply in respect of the supplementary affidavit filed today.
Ten days time is granted to the learned counsel for C.B.I. to file a reply in respect of the supplementary affidavit filed today.
Stay application has also been filed from the side of the applicant. He is apprehending that if the proceedings are not stayed and a judgment is passed in the case pending before the learned lower court complications may arise in disposal of the present application under section 482 Cr.P.C.
The stay application has been opposed by the learned counsel for the C.B.I. He states that keeping in view Section 19 of the Prevention of Corruption Act no stay can be granted in the proceedings.
Let the matter be listed on 14.11.2013. It is directed that the reply by the C.B.I. be filed positively by that date. The matter shall be heard peremptorily on that date.
The learned lower court is advised to fix some date in the case after seven days from 14.11.2013. It is hoped that by that date the present application under section 482 Cr.P.C. may be disposed of finally.
