The contention of the petitioner is that nine posts of Senior Residents were advertised. Out of the nine posts, one candidate was selected under the OBC Category, one candidate was selected under S.T. Category and two candidates were selected in unreserved category. There were two posts for Obst & Gynae. Dr. Rimple Tiwary, who obtained 180 marks, has been selected. The petitioner was next to Dr. Rimple Tiwary, who obtained 163 marks, but without any reason, she has not been selected.

When the matter came up for consideration on 24.9.2013, learned Standing Counsel was asked to seek instruction. The matter was again listed on 10.10.2013. On that day, Learned Standing Counsel stated that instruction could not be obtained. Today again, learned Standing Counsel states that instruction has not been obtained. He prays further time to seek instruction.

Put up on 8.11.2013 as fresh. In case if the instruction will not be obtained or counter affidavit in this regard will not be filed, the respondent no. 2-Directorate (Medical) Noida Employees State Insurance Model Hospital A-3, Sector 24 Noida shall appear in person.
