The petitioner is an Executive Engineer in the Department of Nalkoop Construction Division, Allahabad. By the impugned order the petitioner has been suspended on the ground that in respect of work executed in the year 2008-09 certain irregularities have been found.
Learned counsel for the petitioner submitted that the allegations are vague and no case has been made out that the allegation may result in the major penalty.
We have perused the suspension order.
The allegation appears to be vague and relates to the project for the year 2008-09. It also appears that that the impugned order has been passed without contemplating any inquiry.
Prima facie, we find substance in the argument of learned counsel for the petitioner.
The matter requires consideration.
Learned Standing Counsel appears on behalf of all the respondents may file counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks.
List thereafter.
Till the next date of listing, the operation of the impugned order dated 9.10.2013, Annexure-19 to the writ petition, shall remain stayed.
