The sole relief pressed for by learned counsel for the petitioner at the time of hearing of this petition is that the application dated 31st October, 2012 submitted by the petitioner before the District Basic Education Officer, Ballia for grant of recognition to the petitioner Institution, may be decided.

Learned Standing Counsel appears for respondent nos.1, 2 and 3, while Sri Sanjay Chaturvedi appears for respondent nos.4 and 5.

Sri Sanjay Chaturvedi, learned counsel for the respondents states that a decision shall be taken expeditiously.

This writ petition is, accordingly, disposed of with a direction to the District Basic Education Officer, Ballia to take a decision on the application filed by the petitioner for grant of recognition to the Institution expeditiously, preferably within a period of two months from the date a certified copy of this order is filed by the petitioner.

It is made clear that the Court has not adjudicated on the merits of the case which shall be examined by the District Basic Education Officer, Ballia in accordance with law.
